Terms and conditions for the use of psychological counselling services within the EAP program
1. Content of psychological counselling services
Psychological counselling services are intended for all employees and their immediate family members of companies participating in the Employee Assistance Program (EAP) provided by the Institute for Development and Innovation Ljubljana Ltd.
Counselling services are delivered by counsellors within the EAP network of the Institute for Development and Innovation Ljubljana Ltd., following the Code of professional ethics for psychologists and adhering to the standards of the international Employee Assistance Professionals Association (EAPA) and the Employee Assistance European Forum (EAEF). These services also comply with the Patient Rights Act.
If a counselling service user believes their rights under psychological counselling have been violated, they have the right to file a complaint in accordance with the Regulations on Handling Disputes and Violations of Rights in the Counselling Process.
Evaluation of counselling sessions is an integral part of the psychological services to ensure a high level of professionalism both in content and execution, particularly in adapting to the rapidly changing specific needs of counselling users. To this end, the provider (Institute for Development and Innovation Ljubljana Ltd.) sends the user a text message after the final session, requesting a brief anonymous evaluation of the counseling.
2. Confidentiality of psychological counselling services
Participation in psychological counselling and the content processed therein are confidential, and the provider (Institute for Development and Innovation Ljubljana Ltd.) is obligated to protect this confidentiality (except when there is an official duty to report suspected abuse or violence under the Domestic Violence Prevention Act and Article 191 of the Criminal Code). In the event of a confidentiality breach, the user will be informed in advance by the provider (Institute for Development and Innovation Ljubljana Ltd.). Counselling statistics, such as gender and type of issue, are used to report on counselling utilization within the Employee Assistance Program, ensuring that individual identities remain anonymous.
3. Data protection
The provider of psychological counselling services (Institute for Development and Innovation Ljubljana Ltd. – data controller) is committed to protecting the personal data of counselling service users in accordance with the General Data Protection Regulation (GDPR) and the Personal Data Protection Act (ZVOP-1).
Personal data (name, email, and phone number) will be used solely for the purposes of conducting counselling sessions and the associated evaluation, which is an integral part of the service.
Statistical data, such as gender and type of issue, will be used exclusively for reporting on counselling utilization within the Employee Assistance Program, ensuring that the user’s identity remains anonymous.
Personal data is processed under Article 6(1)(b) of the GDPR. Other legal bases include the Code of Professional Ethics for Psychologists, the standards of the EAPA and EAEF, and the Patient Rights Act.
The Institute for Development and Innovation Ljubljana Ltd. will retain this data until the purpose has been fulfilled.
As an individual, under the GDPR, you have the right to access, data portability, deletion, and correction of your personal data. 4. Changes to Terms and conditions
The Institute for Development and Innovation Ljubljana Ltd. reserves the right to amend these terms and conditions without prior notice. Changes take effect immediately upon publication.
Each new user of psychological counselling services is verbally informed by the provider (Institute for Development and Innovation Ljubljana Ltd.) at the first contact that the terms of service are available on the Institute’s website eap.si.
5. Acknowledgment of Terms of use
By choosing to use psychological counselling services within the EAP program, the user agrees that they are aware of the terms of use.
